Terms of Service

These Terms explain the rules, responsibilities, and protections that apply when you use Planamis.

1. Who operates Planamis

Planamis is operated by Stiven Blandon Urrego, located in Medellín, Colombia.

2. Accepting these Terms

These Terms govern your access to and use of the Planamis website, application, shared spaces, guest access, and related services.

By creating an account, signing in with Google, joining as a guest, or otherwise using Planamis, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use Planamis.

If you use Planamis for an organization or another person, you confirm that you have authority to accept these Terms on their behalf.

Planamis records the policy versions, acceptance time, source, and pseudonymous request identifiers as described in the Privacy Policy.

3. Eligibility

You must be at least 16 years old to use Planamis. You must also be legally permitted to use the service under the laws that apply to you.

Planamis may request reasonable information to verify eligibility or protect users.

4. Accounts and guest access

You agree to:

  • Provide accurate information
  • Keep your password, PIN, recovery codes, invite links, and devices secure
  • Notify Planamis if you suspect unauthorized access
  • Accept responsibility for activity performed through your account or guest session
  • Avoid sharing credentials or impersonating another person

PIN accounts and temporary guest access may have fewer recovery options than email-based accounts. You are responsible for remembering your username and PIN and for maintaining access to your browser or device.

Space owners control invitations and participant access. Do not invite someone or provide their personal information without permission.

5. The Planamis service

Planamis helps groups coordinate casual hangouts and plans through shared spaces, messages, polls, notes, reminders, games, menu tools, place suggestions, expense coordination, and AI-assisted ideas.

Planamis may add, modify, limit, or discontinue features. When a change materially affects active users, Planamis will provide reasonable notice where practical.

Planamis does not guarantee that every feature will always be available, uninterrupted, secure, or error-free.

6. User content

You retain ownership of content you submit to Planamis, including messages, notes, plans, polls, menu information, links, expense records, uploaded files, and other contributions.

You grant Planamis a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and display your content only as needed to:

  • Operate and secure Planamis
  • Display content to participants you authorize
  • Provide requested features, including AI and menu processing
  • Maintain backups and prevent abuse
  • Comply with legal obligations

This license ends when the content is deleted from active systems, except for limited backup, security, and legal retention described in the Privacy Policy.

You confirm that you have the rights and permissions needed to submit content. Do not upload private information, images, financial identifiers, or other personal data about another person without their permission.

Planamis does not use private space content or AI prompts to train AI models.

7. Shared spaces and participant visibility

Content submitted to a shared space may be visible to its owner, members, guests, and other authorized participants. Participants may copy, screenshot, or share content outside Planamis. Planamis cannot control what another participant does after receiving content.

Space owners are responsible for managing invitations and removing access when appropriate. Participants must respect the privacy and rights of others.

8. AI-assisted features

Planamis may use third-party AI providers to generate outing ideas or extract menu information. AI output may be incomplete, inaccurate, outdated, offensive, or unsuitable.

You remain responsible for reviewing AI output before relying on or sharing it. AI suggestions are not professional, legal, medical, financial, safety, or emergency advice.

To the extent permitted by law:

  • You retain rights in the prompts you submit
  • You may use generated output for lawful purposes
  • Planamis does not guarantee that output is unique or eligible for intellectual-property protection
  • Similar or identical output may be generated for other users
  • You must verify locations, availability, prices, opening hours, accessibility, safety, and other practical details independently

Planamis configures supported AI requests to use OpenRouter endpoints with Zero Data Retention.

9. Expenses and payment coordination

Planamis helps participants record, calculate, and coordinate shared expenses. Planamis:

  • Does not hold or transfer money
  • Is not a bank, payment processor, lender, accountant, or collection service
  • Does not guarantee that expense calculations, payment statuses, or participant entries are accurate
  • Does not enforce debts or settlements
  • Does not provide financial, tax, accounting, or legal advice

Participants are responsible for checking amounts, deciding what is owed, resolving disagreements, and completing payments outside Planamis.

Optional bank information, Bre-B keys, QR images, or payment instructions are shared at your own discretion. Never enter passwords, card security codes, online-banking credentials, or other authentication secrets.

10. Acceptable use

You must not use Planamis to:

  • Violate any law or another person’s rights
  • Harass, threaten, exploit, stalk, or impersonate anyone
  • Publish hateful, discriminatory, sexually exploitative, or violent content
  • Groom, exploit, or endanger minors
  • Share another person’s confidential or personal information without authorization
  • Defraud users or misrepresent expenses, payments, identity, or affiliations
  • Upload malware, harmful code, or content intended to disrupt the service
  • Spam, scrape, probe, reverse engineer, or access Planamis through unauthorized automated means
  • Bypass access controls, rate limits, suspensions, or security protections
  • Infringe intellectual-property, privacy, publicity, or contractual rights
  • Use AI features to generate unlawful or harmful material
  • Interfere with another group’s shared space or access an invitation not intended for you

Security research requires prior written permission.

11. Moderation, reports, and enforcement

Planamis may investigate reports and review relevant account or space information when reasonably necessary to enforce these Terms, protect safety, prevent fraud, or comply with law.

Depending on the circumstances, Planamis may:

  • Warn a user
  • Remove or restrict content
  • Limit features
  • Revoke guest or space access
  • Suspend or terminate an account
  • Preserve information required for an investigation
  • Notify authorities when legally required or necessary to address an urgent safety risk

Planamis may act immediately for serious abuse, security threats, illegal content, or risk to users. For less serious issues, Planamis may use proportionate warnings or restrictions.

12. Planamis intellectual property

Planamis and its licensors retain rights in the application, branding, interface, designs, software, and service content, excluding user content and third-party materials.

These Terms grant you a limited, personal, revocable, non-exclusive, non-transferable right to use Planamis for its intended purpose. They do not transfer ownership of Planamis or permit you to copy, sell, sublicense, or create unauthorized derivative services.

You may provide feedback voluntarily. Planamis may use that feedback without payment or obligation, provided it does not identify you publicly without permission.

13. Third-party services and donations

Planamis may connect or link to services such as Google, OpenRouter, Google Maps, Resend, Ko-fi, and other external websites or providers. Their services are governed by their own terms and policies.

Voluntary donations are processed outside Planamis, currently through Ko-fi. Donations do not purchase ownership, special access, guaranteed features, or influence over Planamis. Refunds and payment disputes are subject to the external provider’s terms and mandatory consumer law.

Planamis is not responsible for third-party content, availability, security, or independent actions.

14. Privacy

The Privacy Policy explains how Planamis processes personal data. By using Planamis, you acknowledge that policy and authorize processing where authorization is legally required.

You are responsible for reviewing the Privacy Policy before submitting personal or financial information.

15. Termination by you

You may stop using Planamis at any time. Registered users may delete their accounts through Settings → Profile → Delete account.

Account deletion removes the account from active application records and schedules associated private files for deletion. Some shared, backup, security, or legally required information may remain as described in the Privacy Policy.

16. Disclaimers

To the fullest extent permitted by law, Planamis is provided “as is” and “as available.”

Planamis does not guarantee:

  • Continuous or error-free availability
  • That shared content is accurate, lawful, or complete
  • That users will repay expenses or follow plans
  • That AI output, menus, maps, links, or third-party data are accurate
  • That data loss, unauthorized access, or service interruptions will never occur
  • That Planamis will meet every user’s requirements

Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded.

17. Limitation of liability

To the fullest extent permitted by law, Planamis and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, opportunities, data, goodwill, or anticipated savings arising from the service.

Planamis is not responsible for disputes between participants, missed events, inaccurate expenses, unpaid amounts, unsafe locations, user conduct, AI output, third-party services, or content shared outside Planamis.

Planamis’s total liability arising from the service will not exceed the greater of:

  1. The amount you paid directly for Planamis services during the 12 months before the event giving rise to the claim
  2. USD 100, or its equivalent in local currency

These limitations do not apply to fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or other liability that cannot legally be limited.

18. Your responsibility for claims

To the extent permitted by law, you are responsible for losses or third-party claims resulting from your unlawful content, unauthorized disclosure of another person’s data, infringement of rights, fraud, or deliberate misuse of Planamis.

Planamis will provide reasonable notice of a covered claim and allow reasonable participation in its defense. This section does not apply where prohibited by consumer law.

19. Changes to these Terms

Planamis may update these Terms to reflect legal, security, provider, or service changes.

The “Last updated” date will be revised. When a material change affects your rights or obligations, Planamis will provide reasonable notice and may request renewed acceptance. Continued use after the effective date means you accept the updated Terms where permitted by law.

20. Governing law and disputes

Before filing a formal claim, you and Planamis agree to attempt to resolve the dispute informally for at least 30 days after written notice is received at [email protected].

These Terms are governed by the laws of Colombia, without regard to conflict-of-law rules. Subject to mandatory consumer and local-law rights, disputes will be submitted to the competent courts of Medellín, Colombia.

Nothing in this section prevents either party from seeking urgent relief for security, intellectual-property infringement, or immediate harm.

21. General terms

If a provision is unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.

Failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without permission. Planamis may transfer these Terms as part of incorporation, financing, reorganization, or transfer of the service.

These Terms, together with the Privacy Policy and any feature-specific notices, form the agreement between you and Planamis concerning the service.
